SRDP and permanent impairment: the financial decisions inside the file

A one hour combined session for IVA members and veterans' advocates, paid and volunteer

Facilitated by Witton Lane Advisory, developed with the Institute of Veterans' Advocacy. 10 minutes framing, 25 minutes SRDP, 25 minutes permanent impairment.
Witton Lane Advisory is an exclusive referral partner of Coffs Coast Wealth Management Pty Ltd (ABN 82 153 980 388), a Corporate Authorised Representative of Infocus Securities Australia Pty Ltd (AFSL and Australian Credit Licence No. 236523).

Why this session exists
Ten minutes

Why the IVA is supporting this

Not because advocates need to become advisers. Because the IVA recognises the important role of personal financial advice in the claims process.

Financial advice and supporting veterans

What good support looks like, said out loud and shown on the file

What we might sayWhat a good process can demonstrate
Conflict"We always act in the veteran's interest."Disclose relationships and any referral benefit, preserve adviser choice, record consent and the basis of the referral.
The boundary"I would never give financial advice."A written boundary, a referral protocol, and a file note showing where the advocate stopped.
The decision"The veteran made their own decision."An advice decision recorded and dated before the election was signed.
CurrencyExperience.Versioned material, cited sources, a review date, an assessment and a completion reference with clearly stated limits.
What this session is

Good process made practical: two sets of numbers, clear decision steps and resources you can use independently.

How the Witton Lane programme was built

Education first, with a clear basis for review

Named authorship

Every module carries an author, a version, a publication date and a next review date, visible to the participant.

Cited sources

MRCA, VEA, DVA rate schedules and the Corporations Act personal advice provisions, listed per module rather than implied.

Real determinations

Case studies reconstructed from actual files and de-identified at authoring: no names, dates, units or locations, and statutory figures kept exact.

Assessment and record

An eighty per cent pass mark and a unique completion reference. Public checking tests reference consistency, not proof of learning or a central CPD register.

Arms length by construction

Education stands alone. Referral assistance is separate, disclosed and optional. Attending creates no obligation to use any service.

Honest status

Delivered as IVA professional development. No claim of ATDP accreditation or CPD points until the IVA confirms the basis.

By the end of the hour

What you will be able to do differently tomorrow

  • Read a nil or $0.00 determination without assuming it means nothing is available.
  • Find the enclosure that decides the answer, and know why the headline rate usually does not.
  • Diarise the twelve month SRDP offer clock from the date on the letter, on the day it lands.
  • Hold the pen on a permanent impairment election until an advice decision is recorded.
  • Explain, in one sentence, where your role ends and a licensed adviser's begins.
  • Use a practical checklist, document consent and coordinate advice while retaining the advocacy relationship.

SRDP: the financial reality behind the letter

A permanent, irrevocable election, decided in most rooms on two headline numbers that are not the operative figures.

The mechanism

What SRDP is, and the choice it forces

SRDP is an alternative to incapacity payments under MRCA. Electing it permanently ends incapacity payments. It is tax free, continues while eligibility is maintained (MRCA s209), and is offered after offsets.

Four things that decide the answer
  • The offsets applied to the maximum rate: permanent impairment, VEA disability compensation, and a Commonwealth super offset based on sixty per cent of the statutory reduction (MRCA ss134 to 136), not of gross super.
  • What each option does to the household income test, which is where Service Pension and Partner Service Pension live.
  • The client's age, because incapacity payments terminate by law at Age Pension age and SRDP does not.
  • The partner's position. Certain dependant pathways flow from SRDP eligibility, not the election itself, and have their own eligibility conditions.
The advocacy line

Explaining the mechanism is advocacy. Concluding which option leaves a particular veteran better off is personal financial advice and needs a licensed adviser.

Worked example, de-identified

The offset stack, line by line

MRCA client, late thirties, medically discharged, partner and two dependants
Maximum SRDP rate at the time of the case (current from 20 Sep 2026: $967.20)$937.20 / week
less permanent impairment offset−$421.72 / week
less VEA disability compensation offset−$0.00
less Commonwealth super offset (MRCA ss134 to 136)−$0.00
SRDP payable$515.48 / week
Why the room rejects this offer

Incapacity payments were running at $2,068.01 per fortnight. SRDP payable was $1,030.96 per fortnight. On the two headline numbers it reads as a pay cut of roughly half, and the enclosed Service Pension estimate said $0.00, $0.00, $0.00, $0.00.

The same file, the other column

The nil belonged to the option they were keeping

Per fortnightOption 1: stay on incapacityOption 2: elect SRDP
Primary payment$2,068.01$1,030.96
Service Pension and rent assistance, householdnil$1,706.98
Total$2,068.01$2,737.94
Difference+$669.93

Incapacity payments are assessable income and pushed the household over the Service Pension cut-out, which produced the four zeroes. SRDP is assessed differently, so in this case electing it made Service Pension and a Partner Service Pension payable.

Historical case estimate

About $475,000 over roughly twenty seven years, assuming the difference, household and means test settings stay unchanged. Illustrative only.

The teaching point

A nil page is a means test result for one option, not a verdict on the offer

Where the gain was actually sitting
  • In an enclosure, not the letter: the Service Pension estimate was the operative document.
  • In the other column: the comparison is total household position against total household position, never rate against rate.
  • In the sequence: on this file, the Service Pension claim was lodged and determined before the irrevocable choice form was signed, so the figure was determined rather than estimated. The right sequence for another veteran depends on their circumstances and the advice they receive.

The lower offer paid more from day one, and the whole gain sat in a page most people never reach.

Three more de-identified outcomes

Nil, and nil, and a pay cut

SRDP payable $0.00

MSBS super and permanent impairment offsets consumed the whole rate. Incapacity payments of $67.60 per fortnight were forgone. Separately, meeting the SRDP eligibility criteria can open certain dependant compensation pathways, such as Wholly Dependent Partner pension and Gold Card, subject to their own eligibility conditions. That flows from eligibility, not necessarily from the election itself. A rate of $0.00 is still an election.

A $96.25 per week pay cut

Client in her mid sixties. SRDP $481.00 per week against incapacity payments of $577.25. Incapacity payments terminate at Age Pension age, months away, so the higher figure was weeks from becoming zero permanently.

Nil offer, household pay rise

DFRDB super in payment, SRDP payable $0.00, incapacity payments $821.10 per fortnight. Electing SRDP ended the incapacity payments, which released $1,187.86 per fortnight of combined household Service Pension: net gain $366.76 per fortnight.

And the other direction

One household went backwards on what looked like the better offer, and one file that had been closed for four years was reopened. The pattern is not that SRDP is good. The pattern is that the letter does not contain the answer.

Timing

Twelve months from the date on the letter, and the letter says so once

Why the clock is harder than it looks
  • The date that counts is the date on the letter, not the day it was opened, and post and portal are not the same day.
  • Determinations do not arrive on notice. A matter sits for months, then moves in a fortnight.
  • The inputs that decide the answer sit with three different bodies on three different timetables: an invalidity classification, a superannuation figure, a partner's income, a Service Pension estimate.
  • A veteran who is unwell does not read a twelve month deadline as urgent in month one. Extension powers under MRCA s201 are limited, mainly to delayed or non-received offers, so plan to the twelve months.
Advocate action

Diarise the expiry the day the letter is received, from the date printed on it. Then work backwards. Where relevant, a Service Pension determination can strengthen the analysis, but obtaining one must be weighed against the SRDP deadline: MRCA s201 generally allows 12 months from the offer, with limited extension provisions.

Part one close

The advocate's SRDP checklist

  1. 01Log the letter and every enclosure the day it lands, and diarise the twelve month expiry.
  2. 02Read the enclosures, particularly any Service Pension or income support estimate.
  3. 03Capture the offsets as figures: permanent impairment, VEA, and the Commonwealth super offset under MRCA ss134 to 136.
  4. 04Map the household, not the individual: partner, dependants, super in payment, other income.
  5. 05Check age against the incapacity termination rule before comparing anything.
  6. 06Arrange licensed advice at arms length. DVA may reimburse up to $3,397.18 where eligibility criteria are met; confirm costs before work starts.
  7. 07Hold the choice form until the advice decision is recorded, then have it signed and lodged well inside the deadline.

Part two: permanent impairment
Twenty five minutes

Permanent impairment: sequence, conflict and the critical moment

The notice presents the election. The practical rule when seeking advice is not to sign first; the statutory deadline is generally six months from receiving the notice under MRCA s78, subject to extension and review provisions.

Where the risk is

A medical process with four irreversible financial decisions inside it

  • Lump sum against periodic payment. Presented as an administrative preference. It is a lifetime financial structure.
  • Accepting an interim determination or holding for full assessment. Cash pressure pushes one way, the numbers often the other.
  • Whether to seek review, which requires knowing both what is at stake and what the delay costs the household.
  • Anything interacting with an election elsewhere: SRDP most obviously, but also superannuation and income support decisions running in parallel.
Where these decisions are usually made

In a phone call, on a bad day, with no adviser in the room. Advocates are trained thoroughly on the claim. These four are financial decisions embedded inside the claim.

Part two: permanent impairment
Witton Lane AdvisoryThe Institute of Veterans' Advocacy
The core message of part two

Record the advice, then sign and return

Practical sequence when advice is sought
  1. 01Receive the DVA determination notice containing the election. Record receipt: this starts the general six month election period under MRCA s78.
  2. 02Nothing is signed. The advocate holds the pen and says so in writing.
  3. 03The decision is handed out at arms length to the veteran and a licensed adviser.
  4. 04The advice decision is recorded and dated on the file, before signature.
  5. 05Then the election is signed and returned through the channel DVA specifies.
What we have seen refused

On a file we handled, a veteran signed before advice and returned the signed election afterwards. DVA did not acknowledge the later advice in that process. Record advice before signing and check DVA requirements for each matter.

OpensReceipt of the determination notice containing the election (MRCA s78)The date the offer letter is dated
ClosesGenerally six months after the notice is received (MRCA s78), subject to extensions and review. Practically, do not sign before the advice decision is recordedTwelve months later, with limited extension powers under MRCA s201 for delayed or non-received offers
Advice statusNot mandated. Documented arms-length advice is the clearest way to evidence an informed decision, and a reimbursable allowance up to $3,397.18 may be availableFinancial advice is required before an SRDP election. DVA may reimburse up to $3,397.18 where eligibility criteria are met.
If missedCheck the notice, extension and review provisions with DVA. Do not assume an unsigned election preserves the available choices. The offer generally lapses, or is elected on a headline comparison and cannot be revisited
Say this plainly

Permanent impairment advice is not mandated. Documented advice can support an informed decision and a clear record of its basis. It does not replace the veteran's choice or DVA's election requirements.

Conflict management

Most conflict in this space is structural, not intentional

The structural kind

A relationship that is not disclosed. A reciprocal arrangement nobody wrote down. A fee that moves with an outcome. The risk is an unmanaged conflict, not the existence of a relationship.

The test

A disclosed, documented and optional relationship can be managed properly. Confidence comes from structure and documentation, not from familiarity or goodwill.

The fix, on paper

Disclose relationships and any financial benefit accurately. Offer adviser choice, explain the referral basis, and record the veteran's consent on the file.

Applied to us too

Witton Lane delivers the education. Its exclusive referral relationship is disclosed alongside optional assistance. Veterans remain free to choose their adviser; education does not require a referral.

The human side

The critical moment, and how to slow it down

The decision usually arrives at the worst point of somebody's life: unwell, out of the uniform, short of money, and asked to choose a structure that lasts thirty years. Decision fatigue and diminished capacity are not edge cases here. They are the normal conditions.

What slowing it down looks like
  • Separate the news from the decision. Read the letter today, decide another day.
  • Name the clock honestly: what is actually urgent, and what only feels urgent.
  • Get a second person in the room, with the veteran's agreement.
  • Watch for the signals: repeating questions, deferring entirely to you, wanting it over with.
  • Never accept "just tell me what to do" as permission. That is the moment the boundary matters most.

Practical guidance, check each notice

The referral protocol

  1. 01Identify that an election is in front of the veteran, and record the date on the letter.
  2. 02Confirm in writing that nothing is to be signed until an advice decision is recorded.
  3. 03Offer more than one licensed option where you can, and say why each is on the list.
  4. 04Disclose the relationship and any referral benefit accurately. Confirm the veteran is free to choose another adviser.
  5. 05Check reimbursement eligibility, costs and who lodges the claim. DVA may reimburse up to $3,397.18 where eligibility criteria are met.
  6. 06File note the referral, the client's agreement and the date.
  7. 07Record the advice decision, then have the election signed and returned as DVA specifies.

Why this middle space exists

Shared process connects advocacy and financial advice

Advocates know the claim

Conditions, points, determinations, review rights. Trained thoroughly and to a standard.

Advisers know money

Tax, structure, means testing, superannuation. Licensed and accountable for a recommendation.

The process connects them

Which document is operative, what an enclosure means, what order things are signed and lodged in, and where a matter can stall. Shared process makes both skill sets go further.

How that visibility is produced

Letters and enclosures held against the file, the offer date and twelve month expiry diarised the day the letter arrives, the PI election status flagged at intake, offsets and household position captured as structured fields, and every contact file noted. Process, not product.

The standard, in practice

Good practice on the next live file

  • A nil determination gets read, not assumed.
  • A clock gets diarised on the day the letter lands.
  • A pen gets held until a decision is recorded.
  • A referral records the veteran's consent, adviser choice and the relevant documents.
  • A boundary gets stated to the veteran in one sentence, and evidenced on the file.

Good advocacy has always been about the veteran's outcome. What a good process adds is proof: a file anybody can check.

A useful resource in its own right

The free practice tool: use it without making a referral

  1. 01Identify the letter: SRDP, permanent impairment or not sure. Any advocate, veteran or family member can use it.
  2. 02Record the letter date, the date it was received, and whether the election has been signed or returned, with general deadline guidance. No automatic legal deadline calculation.
  3. 03Work through the relevant document checklist. The guidance is factual, not a recommendation about which financial option to choose.
  4. 04Save or print the checklist, or request assistance separately. No login, personal details or referral are required to use the tool.

The solution, once you know the problem

A letter arrives, and the next step is already built

  1. 01Fictional example: use the practice checklist to identify a PI letter, record dates and check whether an election has been signed or returned.
  2. 02If assistance is wanted, continue to the existing portal with consent. The intended journey includes an email tracking reference, initial contact and document checks.
  3. 03Witton Lane coordinates the request. Personal advice is provided through authorised advice partners. Record the advice before signing, within the applicable deadline.
  4. 04The intended completion confirmation supports the advocate's file. You keep the advocacy relationship and help the veteran follow through with clarity, not doubt.
